8:45-9:45 FMLA: Mitigating Risk When ICE Comes Calling      E. Fredrick Preis, Jr. and Rachael Jeanfreau

In July, 2019, ICE confirmed in a much publicized news conference that it served (and intended to continue serving) thousands of Notices of Inspection to employers nationwide. Such notices are typically accompanied by an Immigration Enforcement Subpoena and require prompt, informed action on the part of the organization. In this session of the conference, we will discuss what to expect in an ICE audit and steps to mitigate risk associated with such agency action.

You asked, we answered. In last year's conference survey, many participants requested a topic which covered the spectrum of defending discrimination and retaliation claims. This year, we will address best practices to avoid such claims and best position your organization to defend the claims when (not if) they are filed, as well as what to expect in connection with the EEOC Charge process and possible litigation which follows.

Telecommuting is an increasingly popular "ask" (and thus recruiting tool) in some facets of the healthcare industry. The ability to telework has also been recognized as a potential "reasonable accommodation" under the Americans With Disabilities Act, including in healthcare job scenarios which are both surprising and alarming. We will identify and discuss risks associated with telework arrangements, and how to minimize those risks through effective policies, procedures, and teleworking agreements.

 2:45-3:15 Perils and Pitfalls at the Intersection of Social Media and Employment      Eve B. Masinter and Philip Giorlando

Did my employee really just say that about our patients? Do I have to put up with this public criticism? Can I discipline for ill-advised posting? Was that a HIPAA violation? Can I use social media as a hiring tool? We will discuss common concerns arising from employee and employer use of social media and analyze all of your burning social media questions.

 This workshop has been approved for 5.5 CE clock hours for professional counselors.  It was not reviewed for NBCC credits.
